Schiller DuCanto & Fleck is pleased to announce that Partner Brendan Hammer will discuss the implications of wearing face masks during family law legal proceedings as part of the upcoming expert panel discussion, “Reading Demeanor in Masked Proceedings” hosted by OurFamilyWizard on March, 18, 2021 (2 p.m. CT). Brendan will share insights on the issues face masks present, particularly the trial lawyer’s ability to conduct examinations and present arguments, read a witness’s demeanor, and gauge credibility.
While regulations surrounding the Covid-19 pandemic continue to change, it is likely that face masks will be around for the foreseeable future. As part of the online panel discussion, Brendan will be joined by speakers Judge Patricia Koch of the 9th Judicial District Court in Louisiana and Julia Simon-Kerr, a Professor of Law at the University of Connecticut School of Law. Attendees will have the opportunity to learn from all three perspectives: 1) how family law litigators are guiding, preparing and presenting their clients in trials and hearings during this unprecedented time, 2) the adjustments practitioners and judges are making in establishing, undermining or determining credibility based on limited facial expression, and 3) how the assessment of demeanor and credibility evidence within the judicial system may change moving forward.

In response to the Covid-19 pandemic, Brendan volunteers for a self-represented litigant program started by the Honorable Grace G. Dickler, Presiding Judge Domestic Relations Division. The program assists those without legal representation in the navigation of coronavirus-related case concerns via phone. Brendan also assists the Court in advising on both pandemic and post-pandemic planning matters.
